Introduction
Welcome to the International Association for Accurate History ("IAAH"), a site committed to promoting accurate historical understanding! Our mission is to gather and display historically accurate sources and to provide a resource for the critical evaluation of historical information. We also offer a methodology for ranking external sources to help you assess the credibility of online historical information.
Our goal is to make verifiable historical knowledge accessible.
Agreeing to These Terms
These IAAH Terms of Use ("Terms of Use") cover all our services and features found on the International Association for Accurate History website (the "Website"). They lay out the full rules for every visitor or user ("User" or "You") of our Website and any other services, applications, and features we offer (the "Services").
These Terms are a legal agreement between IAAH ("IAAH", "us", or "we") and you, regarding your use of any of the Website's Services. So, please read them carefully.
You can only visit and/or use our Services if you fully agree to these Terms. If you don't read, fully understand, or agree to these Terms, you must leave the IAAH Website immediately and stop using all the Services.
By using our Services, you also confirm that you have read our Privacy Policy.
What You Promise to Do (and Not Do)
You confirm and warrant that:
- You are at least sixteen (16) years old and have the legal right to enter into this agreement, either for yourself or on behalf of the person or company you represent.
- You own all rights to the content, comments, and sources ("Input") you submit to our Services, or you have (and will continue to have) all the necessary permissions and authority for that Input. This includes the legal right to access, copy, upload, and publish the Input, both by you and by us.
- You have (and will keep) the full power, rights, and permissions to let us access, process, copy, upload, and use your Input (including for source review and ranking purposes) to provide you with the Services.
You agree and undertake not to:
- Copy, change, create new versions of, adapt, reverse engineer, translate, or break apart any part of the Services.
- Use any illegal methods to gather login details or passwords for our Services or any other third-party services.
- Apart from content explicitly made available for public use, publish and/or make any use of the Services, on any website, media, network or system other than those provided or approved by us, or frame, "deep link", "page scrape", mirror, and/or create a browser or border environment around any part of the Services.
- Act in a manner which might be perceived as damaging to our reputation and goodwill (especially regarding the integrity of our source ranking methodology) or which may bring us into disrepute.
- Reverse look-up, trace, or seek to trace another user of the Services, or otherwise interfere with or violate any user's right to privacy or other rights, or harvest or collect personal information about other users.
- Disable, circumvent, bypass, or otherwise avoid any measures used to prevent or restrict access to the Services, by hacking, password mining, or other illegitimate means.
- Probe, scan, or test the vulnerability of the Services or any network connected to the Services.
- Take any action that imposes an unreasonable or disproportionately large load on our infrastructure or systems, or otherwise interfere with or disrupt the operation of the Services or the servers or networks that host or make them available, or disobey any requirements, procedures, policies, or regulations of such servers or networks.
- Use the Services in connection with any form of spam, fraud, scam, phishing, "chain letters", "pyramid schemes" or similar conduct, or otherwise engage in unethical marketing or advertising.
- Access the Services through any means or technology (e.g., scraping or crawling) other than our publicly supported interfaces.
- Sell, license, or otherwise exploit any use of or access to the Services for commercial purposes, except as expressly permitted by these Terms of Use or with our prior written consent.
- Remove or alter any copyright notices, watermarks, restrictions, or proprietary rights notices contained in or accompanying the Services.
- Violate, attempt to violate, or otherwise fail to comply with any of these Terms of Use or any laws or requirements applicable to your use of the Services.
You understand and agree that if you fail to follow any of the above, or if you misrepresent anything here, we might immediately end any Services provided to you, with or without further notice.
Website Features (Source Ranking and User Input)
Our Services provide an aggregation of historical sources and a methodology-based ranking system for external historical sources. Additionally, registered Users may submit sources for review and comment on sources displayed on the Website.
Source Ranking Limitations. Our source ranking is based on a specific, stated methodology. However, this ranking:
- Does not constitute an absolute judgment of truth or historical fact.
- Should be viewed as an analytical assessment based on our methodology, not as definitive proof of a source's accuracy.
- IAAH is not responsible for the accuracy, completeness, or relevance of the external sources themselves, nor does it endorse the content of those external sources simply by providing a ranking.
- The ranking methodology and any associated text may evolve and change over time.
Therefore:
- You are entirely responsible for critically evaluating all sources, including those ranked by our methodology, before you use, publish, or share them, and for making sure you are legally allowed to use them.
- You should consider the ranking as one tool in your research and use your own judgment to decide if a source is suitable for your purposes.
- If you choose to use, publish, or display content from an external source, you are solely responsible for that decision.
Intellectual Property
Your Intellectual Property: As between IAAH and you, you shall own all intellectual property pertaining to your Input (comments, submitted sources, etc.). We do not claim ownership rights on your Input. You know and agree that in order to provide the Services to you and to maintain and improve the Services, we will need to access, upload and/or copy your Input, to perform our services, including reviewing submitted sources and displaying comments, as we deem fit. You hereby grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to use your Input for this purpose.
IAAH Intellectual Property: All rights, title and interest in and to the Services, including any and all copyrightable materials or any other content thereof which is or may be subject to any intellectual property rights under any applicable law (including any artwork, graphics, images, source and object code, computer code (including html), applications, documentation, derivatives and versions thereof, the source ranking methodology, the "look and feel" of the Services, methods, products, algorithms, data, interactive features and objects, advertising and acquisition tools and methods, inventions, trade secrets, logos, domains, customized URLs, trademarks, service marks, trade names and other proprietary identifiers, whether or not registered and/or capable of being registered (collectively, "Intellectual Property"), and any derivations thereof, are owned by and/or licensed to IAAH.
Privacy
Some parts of our Services involve collecting and using certain personal information (especially for User registration and commenting features). We encourage you to regularly read our Privacy Policy for details on how we collect and use your data.
Disclaimer of Warranties
We provide our Services "As Is" and "as available," without any promises or guarantees of any kind. This includes no implied promises about accuracy, fitness for a particular purpose, non-infringement, availability, completeness, reliability, or being error-free, all to the fullest extent allowed by law.
We specifically do not promise that our Services (or any content from them, including the accuracy of the sources presented or the reliability of the source rankings) are complete, accurate, of a certain quality, reliable, or secure, suitable for your activities, or that they comply with any laws applicable to you. We also don't promise that their operation will be free of viruses, bugs, or other harmful components.
Limitation of Liability
To the fullest extent permitted by law, IAAH is not responsible for any direct, indirect, incidental, special, or consequential damages resulting from any use of our Services, including but not limited to: (1) errors or inaccuracies in any content from the Services, including the source ranking data and methodology; (2) personal injury or property damage related to your or others' use of the Services; (3) interruption, failures, or unavailability of the Services; (4) your or others' access to, use of, or display of content via the Services; (5) events beyond IAAH's reasonable control (including internet or network failures, natural disasters, or acts of war); or (6) loss of use, data, profits, goodwill, or other intangible losses from using or being unable to use the Services, even if IAAH has been advised of the possibility of such damages.
You understand and agree that these limits are a reasonable allocation of risk and a fundamental basis of the agreement between you and IAAH.
Indemnity
You agree to defend, indemnify and hold harmless IAAH from and against any and all claims, damages, obligations, losses, liabilities, costs, debt and expenses (including attorneys' fees) arising from: (1) your violation of any term of these Terms of Use; and/or (2) your violation of any third party right, including any copyright, access rights, property, or privacy right, resulting from your use of the Services.
Governing Law
You agree that IAAH has the right to enforce these Terms against you.
These Terms, along with any related claims or disputes, will be governed by and interpreted under the laws of the State of Israel. This means that any legal disputes will be handled exclusively in the courts located in Tel-Aviv, Israel. We specifically exclude the application of the United Nations Convention on Contracts for the International Sale of Goods.
Termination
You may stop using the Services at any time by simply discontinuing your use of the IAAH Website and Services. We may suspend or terminate your access to the Services immediately and without prior notice for any reason, including but not limited to: (i) you violate these Terms of Use; (ii) you engage in conduct that we reasonably believe is harmful to other users, us, or third parties; (iii) we reasonably suspect fraudulent, abusive, or illegal activity; (iv) we are required to do so by law or court order; or (v) we discontinue the Services (with reasonable notice when feasible).
Changes and Updates
We can change, stop, or end any of our Services (including the source ranking methodology), and/or cancel your access to any of them, for any reason. We can also change any part of these Terms, with or without giving you prior notice, at any time and in any way we see fit.
Notices
We may send you notices in any reasonable manner, including but not limited to: (1) through the Services themselves (like a banner or pop-up on the Website); (2) by email to the address you've given us; and/or (3) through other means, including any phone number or physical address you've provided.
Entire Agreement
These Terms, together with any other legal notices we provide to you, make up the complete agreement between you and IAAH about our Services. They replace any earlier agreements, promises, or discussions, whether written or spoken, between you and IAAH regarding the Services.
